TERMS AND CONDITIONS

These Terms and Conditions (the "Terms") govern your use of the website located at https://www.mandavillastjohn.com (the "Site") and any reservations, bookings, or services arranged through the Site. The Site is owned and operated by Inspired USVI, doing business as Mandavilla, Inspired USVI ("Mandavilla," "we," "us," or "our"), a business based in Illinois that operates the private vacation rental property located at 17B-1 Estate Enighed, Cruz Bay, St. John, U.S. Virgin Islands (the "Property"), which may also be referred to as Mandavilla or Mandavilla Rose or the Upper and Lower Floors.
By using this Site or submitting a reservation request, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the Site or book the Property.
1. About the Property and Booking Relationship
The Site provides information about the Property and allows prospective guests to inquire about and reserve stays. All confirmed reservations are subject to a separate Mandavilla Guest Contract / Short-Term Rental Agreement (the "Guest Contract"), which must be completed and returned in advance of arrival. In the event of any conflict between these Terms and the signed Guest Contract, the Guest Contract controls with respect to your stay.
2. Reservations and Booking
To reserve the Property, you must:
Be at least 25 years of age
Provide accurate guest, contact, and (where requested) home-address information
Submit any required deposits or payments per the schedule provided at booking
Complete and return a signed Guest Contract — within 45 days prior to arrival, or within 48 hours if the reservation is made within 45 days of arrival
We reserve the right to refuse, cancel, or modify any reservation in our sole discretion, including for misrepresentation, inability to verify identity, or violation of these Terms.
3. Rates, Fees, and Payment
Rates vary seasonally. Peak-season rates are higher due to limited availability. Quoted rates are subject to applicable taxes, cleaning fees, damage deposits, and any optional services selected by the guest. Payment terms, including deposit and final balance due dates, are provided at the time of booking and incorporated into the Guest Contract.
Additional fees that may apply during or after your stay include:
$35 per visit for a lockout / safe assistance caused by guest operator error
Up to $200 for smoking violations on the Property or in any associated vehicle
$125 if our rental agent is required to remove trash left behind at the Property
$25–$75 plus shipping for retrieval and return of personal items left at the Property
$600 cistern refill fee may be charged in cases of grossly negligent water use
Repair or replacement costs for any damage to the Property or its contents
4. Cancellation Policy
Our standard cancellation policy is non-refundable and non-changeable once a reservation is confirmed. We strongly recommend that all guests purchase Trip Cancellation Insurance at the time of booking. Guests are solely responsible for insuring themselves against the need to cancel or change travel plans for any reason. 5. Hurricane, Storm, and Force Majeure Policy
No refunds will be given for acts of God or force majeure events, including but not limited to hurricanes, tropical storms, earthquakes, government-imposed travel restrictions, public health emergencies, or other events beyond our reasonable control that impact St. John, USVI.
If you are already on St. John or your arrival date is within 30 days of a named storm, and authorities advise against travel, you will be permitted to hold your reservation on account for a future stay, subject to availability. If you are traveling outside this 30-day window, our regular non-refundable, non-changeable cancellation policy applies. There will be no exceptions to this policy.
6. Check-In and Check-Out
Check-in: 4:00 PM
Check-out: 10:00 AM
Early check-in may be accommodated by knocking on the door and informing the cleaning staff of your arrival; however, the staff will be present until 4:00 PM to prepare the villa. The cleaning team arrives promptly at 10:00 AM on check-out day, and the Property must be vacated to allow same-day turnover.
7. Property Rules and Guest Conduct
By booking the Property, you agree that you and all members of your party will comply with the following rules. Violation may result in additional fees, termination of your stay without refund, and/or liability for damages:
No smoking of any kind in any property, vehicle, or interior space. Violations may incur a fee of up to $200.
No illegal drug use or possession in or on the Property.
No drones may be flown from the Property or surrounding areas on St. John.
No unauthorized guests, parties, or events. Occupancy is limited to the number of guests confirmed at booking.
Keep all doors, windows, and sliders locked, especially at night and when no one is at the Property.
Conserve water and electricity. The Property relies on cistern water and electricity is among the most expensive in U.S. territories. Turn off A/C and lights when not in use; close doors, windows, and sliders when A/C is running.
Trash removal is the guest's responsibility. Dumpsters are located throughout the island.
Recycling is supported on St. John and guests are asked to participate.
Parking is provided for up to three vehicles at the Property. Do not block the neighbor's descending driveway.
Report damages and maintenance issues promptly, ideally upon arrival or as soon as they occur.
8. Optional A La Carte Services
Mandavilla may offer optional add-on services through our island property manager, including arrival/return transportation, grocery provisioning, and extended-stay cleaning. These services are arranged and paid for directly with the property manager and are not included in the base rental rate. Availability, pricing, and payment methods are subject to change and confirmed at the time of booking.
9. Utilities and Service Interruptions
Cable, internet, phone, water, and electricity service in the USVI are subject to frequent interruption. No refunds, credits, or rate reductions will be issued for any service interruption, slow internet, or utility outage, unless the issue was reported to us during your stay and we failed to take reasonable steps to address it. We do not guarantee internet speed or quality.
10. Damages and Damage Deposit
You are responsible for any damage to the Property or its contents caused by you or any member of your party during your stay. We may charge your damage deposit, credit card on file, or invoice you directly for the cost of repair or replacement. Please notify us promptly of any damage so we can address it efficiently.
11. Personal Property and Assumption of Rise
The owner, manager, and rental agent are not responsible for personal belongings that are lost, stolen, damaged, or left behind at the Property. All personal property is kept at the guest's sole risk. Guests are strongly encouraged to obtain appropriate travel or renters' insurance.
By using the Property, guests assume all risks associated with the use of the Property and the surrounding area, including but not limited to risks of burglary, assault, vandalism, theft, natural disasters, steep terrain, water-related activities, and other risks inherent to a remote island setting.
12. Liability Release and Indemnification
To the fullest extent permitted by law, Inspired USVI and Mandavilla, along with our owners, directors, officers, agents, employees, property managers, contractors, subsidiaries, and affiliates (collectively, the "Releasees"), shall not be liable for any personal injury, property damage, death, or other loss arising from your use of the Site, your stay at the Property, or any third-party services arranged in connection with your stay.
Except where prohibited by law, you agree to indemnify, defend, and hold harmless the Releasees from any actions, claims, losses, damages, liabilities, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Site, (b) your stay at the Property, (c) the conduct of any member of your party or guests/invitees, or (d) your violation of these Terms or the Guest Contract.
This Section is in addition to, and not in lieu of, the more detailed Liability Release and Indemnification Agreement set forth in the Guest Contract.
13. Intellectual Property and Website Use
All content on the Site — including images, text, logos, property photography, the Mandavilla and Inspired USVI marks, documents, and downloadable files — is the property of Inspired USVI and its content creators. You may not copy, reproduce, distribute, or use this content for any commercial purpose without our prior written permission.
You agree to use the Site only for lawful purposes and not to interfere with its operation, attempt unauthorized access, scrape content, or use it in a way that infringes on the rights of others.
14. Limitation of Liability
To the maximum extent permitted by law, in no event shall Inspired USVI or Mandavilla be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or relating to your use of the Site, your reservation, your stay, or these Terms — even if we have been advised of the possibility of such damages. Our aggregate liability for any claim relating to these Terms or the Site shall not exceed the total amount paid by you for the reservation giving rise to the claim.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Illinois, where Inspired USVI is based, without regard to its conflict of law principles. Disputes relating specifically to the rental of the Property or to a guest's stay at the Property may be governed by the laws of the U.S. Virgin Islands as set forth in the Guest Contract.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be deemed severed, and the remaining provisions shall remain in full force and effect.
17. Changes to These Terms
We may amend these Terms from time to time to maintain compliance with the law and to reflect changes in our business. Updates will be posted on the Site with a revised "Last updated" date, and material changes will be communicated by email where reasonably practicable. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
